No chance of losing here by TRUXEDO, name already is trademarked TRUXEDO, and TRUXMART is too similar. FNHI is the liable party not the other way around. If FNHI was confident of its claim it would have filed for trademark protection, it didn't because it knew it would most likely be denied. The very fact that FNHI is changing its name is proof positive it was in a weak position in the suit.
