Just as I suspected, the suit was voluntarily dismissed WITHOUT PREJUDICE
When a Plaintiff (TRUXEDO) dismisses case WITHOUT PREJUDICE what that means is that TRUXEDO retained the right to re-file the suit against FNHI.
This is not a final settlement of the case. As I suspected TRUXEDO was willing to dismiss on condition that FNHI comply with TRUXEDO demands, and those demands were to stop and desist from using the TRUXMART name.
Really, this is proof positive that I am right. No Plaintiff retains a right to refile the suit, and the Court allowed this, showing that TRUXEDO still holds leverage over the the head of FNHI, if they don't do what was agreed upon, they will refile the suit.
