The liabilities of the failed company outweigh any concerns about how quickly one can go public. What's the rush, is RAD in financial distress as well?

If you have a competent securities lawyer a well written S-1 filing or Form 10 can be deemed effective on the first attempt to become a SEC registered and reporting company.

So I fail to see how that argument holds weight.
