the company WAS SPECIFIC IN THAT THE SOURCE OF FUNDS WILL COME FROM THE ATVI CASE OR A PUBLIC OFFERING

It does not state in that quote "or a sale of the merimed stake" / "Or a sale of marketable securities"

They were specific sir. READ IT
