At this point, should the company even bother fighting the Zapata case? Just pay up! It's coming out of shareholders pockets now! No longer will it benefit the CEO if they win against Zapata!
Kind of funny how the cash out option changes things totally now! IMSCQ should not contest any of the claims against the company now. Hopefully the CEO says "we've re-reviewed the claims, and no longer have any objection against any of the claims"!
