i think fidler filed the lawsuit in federal court. what i'm not sure about is which regulators (if any) may have asked him to do it. i used to think the company decided to bring the case, but maybe an outside agency insisted they do it, to clean up a very dirty shell. if so, i doubt fidler would refuse, he'd have to comply.
