A little birdy told me that Gorsuch will make a difference in whether the SCOTUS will declare the IPR Unconstitutional. It appears to be leading in that direction. Also, I believe that after any settlement with ACTI, some cash will be used to buy other patents that could be licensed and provide ongoing revenue to the company. JMHO
