It's promulgated by the MM's who take short positions. They can't slow them down so they get OTC to skull them, when that fails they turn to the SEC.

C'mon. You know that's nonsense.

It is, however, true that the SEC is more vigilant about higher-priced pennies. They may turn out to be another CYNK, and the regulators do not want that.
