I would disagree.

First of all, dred scott did follow the law. That was the entire problem. If SCOTUS had ruled differently in dred scott, they would NOT have been following the law. Ironically, dred scott is parallel to the immigration policies we are facing today. The travel ban may end up being the dred scott of our time!

Second of all, while I personally disagree with Kelo, if the SCOTUS didnt set new precedent, we would probably still have segregation in this country...and possibly even slavery. The legislation that ended these things started by the SCOTUS reversing long standing laws.
