was the 2 year old, unsold 35,000 bottles they "sold" to a liquidator for 76 cents per bottle, but never appeared in the financials. Did the liquidator return the bottles as well as the retailers? Or did they simply dispose of them and not pay FBEC?
FBEC might limit distribution to "free samples" only
Because once FBEC's "healthy Hemp" appears in stores, the trademark holder: Healthy Hemp llc will then have actual damages to sue for.
It's not trademark infringement to say you will sell a "healthy Hemp" product. It definitely is trademark infringement to advertise and SELL a "Healthy Hemp" product and the damages can be quantified.
Notice that FBEC doesn't actually ADVERTISE their product.
