I'm not well versed in patent laws but I assume these operations are not exactly the same as Harvey's. If so then I assume they can issue a cease and desists or possible take a royalty fee.

This is not the same type of system as Harvey's. Harvey's breaks down the tire components and allows the separation of carbon black which is the most valuable commodity.
