Great question. The courts seem to use the definitional precedent when it suits them and then decide to change the definition when it doesn't. So who knows!?!? You don't either given the results of the Perry appeal!

Similar to Chapter 11 bankruptcy but not the same. Especially when Fannie Mae, Freddie Mac are the point of discussion.

You show over and over again that you have not done adequate dd. Many companies(including banks) have went into conservatorship and not went thru rship/bankruptcy. They are different by nature. Now, ultimately (un some cases) liquidation/rship/bk happens. There are cases where it doesnt. It seems the longer the cship happens, the more positive the result.
