I'm not denying that, but what puzzles me is that the value of the asset is probably worth more than what they owe the note holders. Potentially a lot more.

The market cap of Delcath before the big fall went over $400 million. Yes it was a bit too inflated at that level, but still. They have now slowly gotten Chemosat back to a level where approval is looking very close. So let's just pretend Chemosat is worth $60 million right now, start doing the math on what that does in a sale.
