JCali....that is why I said Purdue will have a an uphill battle. the burden of proof is indeed on Purdue to prove that the Rexista formula is a copy. to answer your question, No. IPCI will not be compelled to provide the information or a pill to Purdue.

The only possible way in my mind would be how detailed the NDA packet is. Purdue may be able to make assumptions as to what the formula is based on what is described in the NDA. However, that doesn't mean there would be enough to prove.

that is then just one aspect of the answer. once they get past that then IPCI is then claiming that the Purdue patents are invalid as well. It was that, argument that has been successful in the past.
