Jcali. .... none of that information is supplied in the answer what ipci pointed out was that the burden of proof is on the plaintiff for them to prove that Rexista is made using their formulas the defendant doesn't have to disprove Hors devours what their formula is but if the burden of proof on the plaintiff to prove they are using their formula.. the majority of the arguments we're going saying that the patents used By Perdue are invalid and unenforceable. that becomes the basis of why they should be Estopped from being able to hold up the approval process and why they're asking for summary dismissal
