No. Kim has disclaimers because people misinterpet. When Kim says he "expects" and people decide to make that a promise in their head they can and will sue him for "misleading". Hence a disclaimer of forward looking statements and what they are.
Yes that is called marketing. It is a big part of a CEO's job. Making people want your product through statements is how sales are made. V-8 is a great example. The V use to stand for Vegetables. It is a very healthy drink. But the company also makes V-8 fruit juices. Those juices like V-8 Splash are sugar water and 5% fruit juice. Terrible for you but the V-8 logo is right in your face "misleading" you to think it's healthy.
