What are you even talking about? Who said buy or sell based solely off the 10k?
I said the (in fact another poster mentioned it first) that the 10k clearly states the Company - based on their knowledge of the case feels that the CAFC will not rule this calendar year.
That is important information for anyone in, entering, or exiting this stock as it does have implications on dilution for instance and when people can expect a catalyst and clearly this is a catalyst driven stock at this stage.
If you have issue with that, that's your problem - any investor should trust the company over message boards whether you like it or not.
