#26104 RE: WeeZuhl #26020

WeeZuhl, Patent 9,492,389 Tamper Resistant concerns CURED tablet. Claim 1 states: "1. A cured shaped pharmaceutical tablet comprising: (1) at least a first compression shaped and then air cured matrix, wherein said curing is without compression, by heated air having a temperature of at least about 62° C. for a duration of at least about 5 minutes,..." I do not think patent is about having a polyethylene oxide (PEO) core of at least 54%, which I think you have been arguing with others.

Patent is about curing the tablet. I would guess the curing hardens the PEO and makes the tablet harder to crush. Rexista is not too hard to crush, and I assume Rexista tablet is not cured.

PODRAS patent describes the manufacturing process for two versions. Example 29, which corresponds to the formula you posted, dry mixes the ingredients to form granules, then uses compression to form the core. Example 24, uses hot melt extrusion which is then ground into granules, then uses compression to form the core.

Rexista does not use curing of the tablet, assuming Rexista is manufactured similarly to the PODRAS patent. So Rexista does not infringe on the Tamper Resistant patent.
