Gelling was obvious, abuse-proof relates to crushability and probably does no apply. I think previous appeal court found gelling patent invalid because it was obvious. The abuse-proof patent concerns thermoformed tablets to create a hard to crush pill. I do not think Rexista is thermoformed, and Resxista is not too hard to crush.

Previous 25 PPM patents were found invalid because it was an anticipated invention. That is low amount of some toxic ingredient when producing Oxycodone.

There is a patent which was granted after IPCI filed. I do not think Purdue can sue for the Dec 2016 patent. The document does not mention when Rexista was filed. It only mentioned that paragraph IV notice was received February 24th, 2017. So law firm threw in an extra patent.
