That could be "unfair use" of a copyrighted song, inhibiting a possible sale to a third or at least a second person :-)

I remember my first Sony Walkman, which had a double jack for earphones and I bought a second pair just to share. People's jaws would drop, they couldn't believe how good the sound was from this little thing.
