I was disappointed in no attorney fees once more. There is no incentive for anybody to settle as long as blatant, willful infringers never have to pay triple damages or even have to cough up attorney fees.
It was also a joke when Finjan was only granted the treasury rate for interest. The judge said they didn't show they had to borrow money in lieu of Sophos signing a licensing deal in good faith even though they had to do the preferred shares.
Another update from earlier in the week in Symantec case. Settlement conference went nowhere. Schedule is set now going up to trial in April of 2018. Once more... no incentive to settle with this broken system that takes 3 to 5 years to get paid by willful infringers who come out better EVEN IF THEY LOSE than if they would have signed licensing deal in the first place.
