The circumstances here is that the government is driving them into bankruptcy by depleting their capital reserves and confiscating their quarterly earnings. This is completely counter to the stated mission of a conservatorship and the courts have refused to hold the government accountable. This is not what anyone could call a normal bankruptcy proceeding should it come down to that.
