That list of exemptions was incomplete.

I was going to correct you on that, but you caught it yourself. Nice of you to admit it. No harsh words from me.

This is a classic example of speculation. All anyone knows for sure is the form was filed and no one knows why (was it a gift or not). This is why I stick to the numbers and it works okay for me. Everyone has their own investing style and mine is to stay away from speculation but to each his own.
