At one time (several years ago) the direct damages were listed as more than $250 million by someone who seemed to have inside knowledge (moniker "Slashnuts"). Damages have continued to accrue since that time. Punitive damages would be on the table as well since during the proceedings the defendants said that they knowingly used this technology and did not pay royalties as they believed the patents were not valid. Thus, a number in the billion dollar range could be bantered about in this discussion.

A reward by the Federal Circuit on appeal (will never happen in McKinney's Court) anywhere near this number would probably bankrupt all the defendants. Then the counter suits would start flying as ICM has pledged to indemnify the other defendants. So do not hold your breath. In any event, does anyone have faith that KK could/would use this windfall productively for the shareholder's benefit?

That said, and this has been my position for years -- the notoriety of a sub penny company coming into such a windfall is the play here. You know what they say: buy on rumor, sell on news. Never more appropriate than for KK/GERS where the news once people figure out what is going on with KK would not be positive.
