I hope you're right! There are tons and tons of patents that don't work or were never brought to market because it didn't make economic sense. So, I've always been under the impression that one gets the patent applied for, when making business plans. Clearly they would not be at this point without clear legal and proprietary rights established, so I'm not going to lose any sleep over it.
I am sure there is a lot more to this story, because again, the uspto.gov database would show patents applied for because those have protections built in for years until the patent is approved.
