The Judge has already compared our recovery to being like "finding money in the couch". He thinks we're all a bunch of penny stock investors who would be thrilled with any recovery. Of course, that was his assessment early on in the proceedings.
But, this was hugely concerning to me. I wrote the Equity Committee and the US Trustee after reading this. I respectfully asked for their support in brining to the light the actuality of the situation. This is not your typical penny stock bankruptcy.
I'm very hopeful the Judge listened to the Equity Committee and is not just going to fast track things at the benefit of expediency, but the detriment to shareholders. In fairness, he has given us enough standing to likely give us a bit of leverage in a settlement. But, I think he could have done more if he really understood the nightmare investors have been dealing with.
