Unusual Development!
My first response to this was dismay -- we certainly don't want litigation between CDXC and its single biggest customer. But the more I thought about it, the stranger it seems.
Elysium just got a big round of funding, so they don't lack money to pay. Nor do they have another source of NR/Ptero. Nor do they lack demand (or else they would not have gotten additional funding). So what gives?
You wouldn't need to go to federal court to resolve a simple contractual issue, and CDXC wouldn't be suing if there were any other way.
So the most likely conclusion, I think (we'll find out for sure eventually), is that Elysium is using their size to unilaterally renegotiate favorable terms, and CDXC is having none of it.
