The PowerUp case is not frivolous. But you need to know the difference between a criminal case and a civil one. The case between TALK and PowerUp is a CIVIL case between two private parties. There is no prosecutor or gag orders. The links you provided refer to Federal criminal cases, and therefore are not applicable.

The PowerUp case has NOTHING whatsoever to do with TALK's failure to file their legally required SEC documents. TALK management is instead just lazy and/or incompetent, or are trying to hide the negative information of what is really going on from their own shareholders.
