It's sad but true that most bad deeds go unpunished. Yes, Gene has strayed from from the road of ethical behavior. No, IMHO, he has not gone down the road of crime. Gene's punishment will be to see the value of his stock go to zero. My thoughts go out to the bulls who did nothing unethical but will get the same outcome.
