....and other legal minds have commented on how lousy and lazy his opinion really was. The panel will have to paint their picture carefully so as not to embarrass a judge who shirked his duty.

Of all the briefs filed in all the cases so far, I actually think the rationale laid out in the new Collins case is the best put forward. Of course, they also benefited from having so much lead-in given them in all the previous litigation.

The thing I note about Collins is that assuming Session's confirmation as AG and new direction he would be likely to impart to DOJ in all this Fanniegate stuff... the Trump agenda is heavily centered on clawing back regulatory overkill. It would be only logical to envision a closure of FHFA and several other colloquial agencies and the emergence of a broader and board-managed oversight panel that would meet the designs identified as constitutional in Collins and as recently ruled in the consumer finance protection matter. This would make resistance to releasing most or all the protected documents moot and inconsistent with the new administration's goals (at least as thus far suggested).
