HERA castrated the Judicial branch - I bet they don't want that to become precedent - the fact that it's gotten this far has to be embarrassing enough for the Judiciary.
Judges like Sweeney are calling it out and the gov't can only go for the hail mary.. we'll see if the appeals court in the court of claims thinks one of their judges was actually out of line. I wouldn't bet on that given the mockery that HERA makes of their sole purpose for existing.
