I think they saw that the company's circling the drain and figured that playing the victim, or even filing a lawsuit themselves, was their best defense against conspiracy to commit fraud charges.

Also, going in front of a judge and complaining that you never got your cut from a criminal conspiracy you were knowingly participating in requires even more cheek than these blatant crooks have shown to date.
