I don't think you understand how these things work. There was no "case". There was litigation to compel Tracy to comply with the subpoena. He eventually agreed to do that, so the matter was closed.

That does not mean the investigation was closed.

The SEC investigation is ongoing. I suspect charges will be forthcoming. Where there is smoke there is fire.

And hijacked shells are NEVER legitimate.
