We, I mean all of us need to flood IPCI WIth E-mails asking for PR. They can't deny the masses, right!?!?

Fabius...I'll try and answer your points as best I can.

1.I agree they should make a PR if they decide to now hold off until 1QE17 but nothing in the law says they have too. just like they previously have pushed back the filing they never officially updated us with a PR. we find out when they go before a group with a presentation and read it there. again, its a valid complaint we have all had over the years with Mgnmt. we just learn to either live with it or have the right to sell, but I do believe its why we dont see significant price action like a normal company. its tight control they have on this. a lot of people dont like that. I will add my own thoughts that they surly should give this new Regulation to their legal team for evaluation. delaying 2 months now could save countless months on the end side. but at the least if they need to be prepared to now come into compliance with this if they file after Dec 5th. it does place new regulations on the filer as well when it comes to notification of the current patent holder.

2. I personally don't see them needing to raise cash until mid December based on normal operating costs and cash on hand. but thats always an unknown, we dont what exactly what they are working on at any given time nor their actual income.

3.I agree, this could change the timing of any partnership. they could now ask for the upfront payment to be split. pay us X amount now and then the balance upon your filing the NDA based on legal looking into advantages of holding up the filing. so really it would just flip what we see first. a partnership instead of the filing. if however their own legal team decides no benefit to hold off they can still file early before these regs take effect and proceed as planned. the real key is these new regs really limit when a company can sue and puts in place beforehand any legal arguments to be raised on patent issues that the FDA can then look at themselves to discount. basically giving the FDA a quasi judicial role in making a ruling.
