I see. Well as stated, I don't think any of us are patent lawyers so evaluating Bungies legal team is a bit silly. We don't have the experience or expertise to do so objectively.
Also, until we see the ruling we really have no idea how effective or ineffective they were. I'd caution reading what you want to see out of a transcript, unless of course you are a software engineer with a patent law degree, then I would stand corrected!
Finally, the lawyers work with what they have, they may or may not have a strong case (thus it can often be interpreted as poor legal skill but they may not really have much to work with). Again, however I would caution making any evaluations on areas we really don't have the expertise to opine on.
