The implications from this, in my opinion flawed, logic would require communications between multiple lower courts from the higher court that telegraphed their rulings. I feel like that is a big structural no-no in the judicial system as it would lead lower courts to get biased results from higher court guidance.
They could have easily all just rushed to punt and let the appellate court rule on this case that involves the gov't stealing upwards of $200 Billion.
