not really

what we have is the same decision repeated in several cases so that is one ruling -- a ruling briefed and awaiting decision on appeal

we do not know what the judges in the various referenced cases would have done if there was no prior decision on nearly identical issue (motion to dismiss approved due to HERA language)

note that I present the issue being appealed is the motion to dismiss on grounds that HERA precludes a judicial review -
