The denial itself isn't all that important. What is important is the text in the denial. The court stated that the motion was unimportant because the answer to plaintiffs questions might be moot if the court rules in favor of defendants motion to dismiss based on Perry.
Basically, the court said that they don't want to waste time or effort until after they decide whether to dismiss the case...and then they referenced Perry like they were already convincing themselves to. Not good for this case.
