Wouldn't a merger require a public filing? If in the time a RE broker knows RXI is vacating a premise they could make a trade of the stock (depending on the known reason for the move) with insider information.
Looking at the floor plan of the available space and the floor plan of the entire complex, this is a different "suite" of the building. Plus, I called the coffee shop in the building to ask if the space for rent was Suite 1 and they said no.
