Yes...that is true. It is not legal precedent in the appellate case that is directly challenging it.

To believe otherwise would simply be insane.

I can see it now....

Appellate Court Judge: In reviewing Lamberths decision, we rely on Pratt that says Lamberth is correct. And therefore, we will rely on A LOWER COURT decision and find in favor of Lamberth.
