Is money returned by Treasury to FHFA
Is money returned by Treasury to F and F directly

?

Hard for me to see the court deciding they can not review the FHFA and then acting against Treasury - but that is interesting - especially if the money received so far > 10% must be returned

(IMO that might prompt a fast resolution to who owns what so the Treasury can issue stock and reimburse itself for the money it sends somewhere)
