Yes, LATE. The 10Q was due Aug 15. The 5 day extension meant it was due Aug 22. They filed late on Aug 22 AFTER the cutoff. So yes, I believe it was late.

Like dropping your tax return at the mailbox AFTER they have picked up mail on April 15. It won't get postmarked on April 15 so it is late.
