On 7/15, a joint emergency motion was submitted to the court urging the court to make a ruling on the pending motion to dismiss the appeal. If you read the document you can infer from the verbiage that Johnson and Strickler don't really want to or intend to present the opening brief (due on July 20th) and are urging the court to rule asap (uhh, maybe because they know they have NOTHING and know they are screwed! - as I've been saying).
The verbiage from the document which is a giveaway, at least to me:
A decision on such pending motion is seen by the Parties as necessary before any briefing is submitted and the resources of the Court are expended on an appeal that may be for naught considering the ramifications of the pending motion to enforce settlement and the opposition thereto.
The Strickler/Johnson opening brief is now past due! It is my opinion based on these filings that the Court ruling comes soon. TMSH should be on high alert
