I am not sure if it is the same guy. I am not call him out one way or another. He is listed in the SEC filings as a consultant to the Company. Even if it were the same person he wasn't adjudicated guilty. The SEC settled for a consent judgment [not a finding of guilt] without admitting or denying the allegations.

This is from the 10-K. He seems to be the "go to" person for information about GBBT.

"Mr. Beatty is obligated to provide us with up to 120 hours of services each month. His services include consulting for sales, promotion of our products, corporate governance, capital formation and financing options, and launching the Company's products in the public marketplace."
