Nope, you are correct. I have no ability to predict what the courts will eventually conclude. I only know what I think they SHOULD conclude.

Firstly, it was Ed Demarco, not Mel Watt, that apparently decided to not declare receivership for Fannie Mae's inability to pay the 10% SPD from 2008 to 2011. He was most kind to shareholders to not pull the plug, especially when many in government would have applauded and cheered for such a wind down end-game.

Blame Treasury and what "they wanted" as you wish, but UST does not make policy. I think you might understand better if you alternatively sought answers from the actions of the House Budget Committee and its Chairman, Paul Ryan, when in the 2012 budget impasse he clearly sought a dismantling of both GSEs. Why blame Treasury or Tim Geithner for Amendment 3? In 2012, the GSEs had returned to the taxpayers a PITTANCE compared to the bailout money and other privileges they were granted under conservatorship.
