Did Kyle ever turn over the ClearTrust documents? They claimed they had them available at every hearing, so why did Kyle suddenly ask for some sort of NDA only to go back on his word?
Just because he said he was happy to do it, doesn't mean he is. He's LIED to the Court repeatedly.
Oh, and the bottom of every filing Craig references the Defendant's email. He knew the email addy changed. The Court docs show that. Technically Kyle might be off the hook for not giving notice, but it was a Kowardly move for someone who claims to be "happy to do it."
