This is some scary bullchitt; it is so easy to get to get this charge against you. Hell, you don't even have to be the instigator, if you are hit and strike back in anyway it can be considered act of violence. I know of a man who has been charged with this for restraining the hands of woman so she could not keep on hitting him!
True Story, these guys should have won this; this has got to change.
Here's another true story. I once bought five guns off of a fellow who had a black eye and some other injuries to his face, he was the neighbor of a friend. I got a hell of a good deal on them as he was in a hurry. After the sale I asked him what was up.
He explained to me that his woman started to kick his azz the day before, and that to stop her he threw her to floor to get out of the door she was blocking and striking him to stop him from leaving. I verified this from my friend who was in the apartment when this went down. Long story short, he was out of jail the next day, had a restraining order on him and that is why I damn near stole five guns at a great price.
I asked why he did not just pawn them, in that way they would be safe. He said that his brother had been through this and that if they come after your guns, guilty or not guilty you almost never get your guns back. This is something I know to be true, I know two different people that cops had taken guns from that never got them back, even though they were found not guilty.
