Believe they have to get current with filings before they can apply and we don't even know if they meet Nasdaq's listing requirements at this point as company was in process of closing down before Shkreli etc. Not to mention, the plan had a little blurb stating that they would do all they could but they might not be able to uplist so next few days should tell the story.
