There are plenty of pump and dump attorneys that write fraudulent 144 Opinion Letters to remove the restrictive legend from the stock.

There are so many ways around what you posted - the "investor" could put part of the stock in his wife's name to stay below the 10% threshold - most only go to 9.99%.

Or they could use the Rule 3(a)(10) rule to circumvent the the restrictions.
