What counter claim?

Did you file something? Ryan has make excuses on the record but no counter claim of which I am aware has been filed.

Ryan Drexler is lucky he wasn't criminally arrested. In many jurisdictions, it a crime to misuse proceeds and not pay the subcontractor.

Specifically this relates to construction contractors but this situation is similar. Ryan sold product for $32m owing the supplier $22.5m and never paid the supplier but used the proceeds for other things like paying Ryan's own salary.

Here is an example of a jurisdiction were theft is prosecuted criminally.

Theft by Contractor

A home improvement contractor may be guilty of theft by contractor under Wisconsin Statutes section 779.02(5) if the contractor takes money from a consumer and uses any of that money before paying subcontractors. County district attorneys prosecute criminal theft cases. (see Wisconsin Criminal Jury Instructions):

Hey Bad,

Can you provide a screenshot or copy/paste (like Cody and I provide often) of the actual counter claim or even evidence of one existing, to which you keep referring? I may have missed it and you state it is in the filings. Can you post evidence so that I may view?

The mediation is complete so not interested at all in Ryan's excuses why he doesn't pay his bills, but in an actual legal counter claim in response the Capstone lawsuit filed recently.
